These terms describe the agreement between The PE Playbook and the educators, schools, and other authorized adults who use the website and application.
1. Acceptance of these terms
By creating an account, purchasing a membership, or using The PE Playbook, you agree to these Terms of Use and our Privacy Policy. If you use the service for a school or other organization, you represent that you are authorized to use the service in that role. If you do not agree, do not use the service.
2. Eligibility and accounts
The service is intended for adults, including teachers, school employees, administrators, and other authorized users. Students may not create accounts. You are responsible for providing accurate account information, protecting your sign-in credentials, and promptly notifying us of suspected unauthorized use.
3. Educational use and professional judgment
The PE Playbook provides organizational and instructional tools for physical education. Team suggestions, fitness views, attendance tools, recognition features, schedules, timers, scoreboards, and other outputs are aids for educators. They do not replace professional judgment, required supervision, school safety procedures, medical advice, or official school records.
You remain responsible for instructional decisions, student safety, the accuracy of information you enter, and retaining any records required by your school or applicable policy.
4. School and student information
You may enter school, class, teacher, and student information only when you are authorized to do so for an educational purpose. Do not enter information that your school or district prohibits, or information that is not reasonably necessary for your use of the service.
You may issue a permanent student QR page only to the student it belongs to and for an authorized educational purpose. The same QR code may be reused for daily questions and other authorized student features; sending new questions does not require a new code. Protect QR codes as private access links, do not post them publicly, and pause or replace a code promptly if it is lost or shared with an unauthorized person.
The PE Playbook does not claim ownership of workspace information entered by users. You grant us a limited right to host, process, transmit, and display that information only as needed to provide, secure, maintain, and support the service as described in the Privacy Policy.
5. Memberships and billing
Available plans, features, prices, and billing periods are shown on the Membership page and during checkout. Basic may be offered as a one-time purchase. Plus may be offered as a monthly or annual subscription that renews until canceled through the billing portal or as otherwise provided at checkout.
Stripe processes payments and manages payment methods. Taxes may be added when applicable. Cancellation and refund rights are governed by the information presented at purchase, the Stripe billing portal, and applicable law. Canceling a subscription prevents future renewal but may not immediately end access already paid for.
6. Acceptable use
You may not misuse the service; attempt to access another user’s account or workspace; interfere with security or availability; upload malicious code; scrape or reverse engineer protected portions of the service except where law permits; use the service to violate another person’s rights; or enter, share, or expose student information without appropriate authorization.
7. Ownership
The PE Playbook application, design, branding, software, and original content are owned by The PE Playbook and its licensors. Subject to these terms and your membership, we grant you a limited, non-exclusive, non-transferable right to use the service for its intended educational purpose. No ownership interest is transferred to you.
8. Availability and changes
We work to keep the service available and reliable, but uninterrupted or error-free operation is not guaranteed. Features may be updated, added, limited, or discontinued as the product develops. We may temporarily restrict access for maintenance, security, legal, or operational reasons.
9. Suspension and termination
We may suspend or terminate access when reasonably necessary to address nonpayment, a material violation of these terms, security risk, unlawful activity, or harm to the service or its users. You may stop using the service at any time and may request account deletion by contacting support. Provisions that by their nature should survive termination will remain in effect.
10. Disclaimers
To the fullest extent permitted by law, the service is provided “as is” and “as available.” We disclaim implied warranties of merchantability, fitness for a particular purpose, and non-infringement. These disclaimers do not limit rights that cannot lawfully be waived.
11. Limitation of liability
To the fullest extent permitted by law, The PE Playbook and its operator will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost data, revenue, or opportunity arising from use of the service. Our total liability for claims relating to the service will not exceed the amount you paid to The PE Playbook during the twelve months before the event giving rise to the claim. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.
12. Changes to these terms
We may update these terms as the service changes. The effective date at the top will be revised when changes are posted. Continued use after updated terms take effect constitutes acceptance where permitted by law.
